Zoning Board of Appeals
Duties:
The Zoning Board of Appeals (ZBA) was established by local law by the Village Board of Trustees pursuant to the provisions of Section 7-712 of the Village Law. Each member is appointed for a term of five years. The New York State Legislature gives the Village the authority to appoint alternate members, pursuant to Chapter 137 of the Session Laws of 1998, to substitute when regular Board members are absent or unable to participate on local land use matters or applications due to conflict-of-interest situations.
The significant duties of the ZBA are to:

Conduct public hearings on all zoning variation requests and to prepare findings of fact based on the evidentiary record.

Make a final determination for any variation request based on the evidentiary record, finding whether the applicable standards for zoning variations have been met or not, and granting or denying the variation.

Hear and make final decisions on administrative appeals from any Village Zoning Law decision or interpretation.
